Altopa Privacy Policy (last updated: March 18, 2020)

At Altopa we take your privacy seriously. That said, we want to make sure you understand everything you need to about the information you provide to us or that is collected by us and how we use it. With that goal in mind, we’ve developed the Altopa Privacy Policy, outlined below. This Privacy Policy explains Altopa’s privacy practices for Oblend Platform (“Oblend”) users. By using Oblend, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is incorporated in, and subject to the terms of Altopa’s Terms of Service. While we reserve the right to change this Privacy Policy at any time, if we make any material changes to our Privacy Policy, we will notify our users and will post the adjusted policy on the website and update the “last updated” date set forth above. Therefore, we encourage you to check our Privacy Policy whenever you visit the website to see if it has been updated since your last visit. PERSONAL INFORMATION WE COLLECT

When you use Oblend, we automatically collect certain information about your device, including information about your hardware, time zone, and some of the cookies that are installed on your device. Additionally, when you use the Oblend App, we collect information about your usage including your searches, blend adjustments, quantity, frequency, size and type of dispenses, and other information about how you interact with Oblend. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

  • We track log files on Oblend (i.e., logs of transactions and usage, like search and dispense data) and use them to analyze trends, administer the Oblend, track Oblend usage, and gather broad demographic information for aggregate use. We might link some or all of this information to personally identifiable information. We only use information gathered from these activities for operational purposes and to improve and personalize your Oblend experience.

When you create an account and make a purchase on Oblend we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number.  We refer to this information as “Order Information.”

As a part of our service offering, you may be given the option to provide feedback to us in the form of multiple-choice and short textual answers.  We refer to this information as “User Feedback”.  

When we talk about “Personal Information” in this Privacy Policy, we are talking about information  Device Information, Order Information, and User Feedback.

USE AND DISCLOSURE OF PERSONAL INFORMATION

Altopa will not sell, rent, or share personal information with third parties without your prior consent except in the limited circumstances described in this Privacy Policy.

  • Consent: If you are using Oblend in coordination with a care provider, with your explicit consent, we will disclose your Personal Information to your care provider in order to provide you with products and services that you have requested. 

  • Altopa’s Own Business Purposes: We use and disclose information about you for our own internal statistical, design, or operational purposes, such as to improve our service offering, to understand need and usage patterns, and to understand demographic, user interest, purchasing and other trends. We might outsource these tasks and disclose personal information about you to third parties, provided the use and disclosure of your personal information by these third parties is restricted to the performance of such tasks. We might also share personal information with third-party vendors who assist us in performing internal functions necessary to operate our business. We require our third party vendors to keep such information confidential and to only use the information for the purpose it was provided. 

  • Protection of Altopa and Others: We disclose personal information when we believe it is appropriate to comply with the law (e.g., a lawful subpoena, warrant, or court order); to enforce or apply this privacy policy or our other policies or agreements; to initiate, render, bill, and collect for amounts owed to us; to protect our or our users’ rights, property or safety; or to protect our users from fraudulent, abusive, or unlawful use of our website; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of personal information without delay. 

  • Business Transfers: Information about our users, including personal information, might be disclosed as part of any merger, acquisition, debt financing, sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personally identifiable information could be transferred to third parties as one of the business assets of the company.

SECURITY

We use reasonable security measures to store and maintain personally identifying information so as to protect it from loss, misuse, alteration or destruction by unauthorized parties while it is under our control. We use secure socket layer (“SSL”) encryption when transmitting certain kinds of information, such as payment information, over the Internet.

MINORS

If you are under the age of 18, please do not attempt to register with us on our site or Oblend or provide any personal information about yourself to us. If we learn that we have collected personal information from a person under the age of 18, we will promptly delete that information. If you believe we have collected personal information from a person under the age of 18, please contact us at support@altopa.com.

EUROPEAN PRIVACY RIGHTS

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example, if you make an order through the website), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding the disclosure of personal information to third parties for their direct marketing purposes. We do not provide your personal information to any third party for their direct marketing purposes without your consent. If having provided your consent, you would like to revoke your consent to future disclosure of your personal information to third parties, send a request to privacy@altopa.com with “California Opt-Out” in the subject line. Please note that this opt-out will not prevent the use of information that has already been disclosed to third parties with your consent and you should contact them directly to opt-out from such communications.
